The Education Code lays out a clear framework for addressing serious disciplinary and performance matters, but districts who limit themselves to those procedures often overlook other valuable4 tools to address and correct problematic employee conduct before it escalates to higher levels. In this session, we will discuss potential options for implementing intermediate disciplinary and performance measures and strategies for successfully negotiating provisions for your district. In addition, we will touch on key principles of effective documentation, as a critical tool in avoiding and defending claims of retaliation and other unfair practice allegations when districts are called upon to issue critical performance reviews or discipline for employees who have engaged in protected activities.
